  • I need advice on unemployment appeal! HR lied about a no call no show...?

    My employer has a zero excuse 12 point attendance policy. I have a chronic health condition that I found out from my doctor should have been covered by FMLA the whole past year that I've been having issues, she brought up FMLA when I told her I was about to point out due to the condition. I didn't get covered until I was at 11 points.

    February comes and the artic vortex hit our area. On the morning of February 18 I went out to start my car for work and my battery was dead, I'm sure due to the subzero temperature. I immediately called work and let them know that I was going to be late and the reason, I figured I would be able to get a ride or a jump pretty quick. I was wrong, by 6:54 I knew I wasn't going to be able to get there by 7:30 (it's a 30 minute drive on good days and the roads were still pretty bad) so I called and left another voicemail as well as text my HR manager letting her know what happened and I understood that was my final point. She texted me back and said that she was 'sorry things didn't work out' and she 'wished me the best'. I filed for unemployment and received a letter from the state saying I was denied for 602-misconduct. My employer said that I was a no call no show on February 19, the day AFTER I pointed out! I sent in my appeal already, any advice going forward would be great! 

    And I was with the company for 10 years and made $65,000 yr.

  • UK based question....Can my manager be fired for bullying?

    I am about to put in paperwork to ACAS for bullying and harassment at work which will lead to early conciliation, failing that I will then take the company to tribunal. I have a strong case where paperwork, evidence of my grievances and complaints not being dealt with and witness statements are concerned. I have also been advised I will definitely win my case whether the company settles at early conciliation or it is taken to tribunal.

    I was wondering, what happens to the managers that cause employees to take their companies to early conciliation or tribunal? The bullying and harassment was being done by a manager? Is there any reprimanding that is done or do the company just pay up and leave it there?

    I'm an on demand Courier and I'm paid 50% of what the person I contract from charges. Am I entitled to have a copy of their rate card and know what they are charging their clients to make sure I'm receiving my 50% accurately.

  • Lack of Work unemployment?

    I work for a greenhouse and my boss continuously gives me days at a time off after guaranteeing me 40 hours, it started with a few days here and there but then it was a full week because there wasn't any work. Last night she texted me and said she is laying everyone off due to lack of work for at least another week or two and told me to file for unemployment. Here's the issue I see with that, it's seasonal work, we only work there 4 months out of the year and so far it has only been two, from my knowledge you have to work 18 weeks in the same company to file for unemployment. Would I be eligible to receive benefits while I'm out of work because of this or what can I do? Obviously I am looking for other work opprotunities in the mean time but this was sudden and unexpected and at no fault to my own. is there any options for me?

  • Is this an unethical business practice ?

    Why would a store manager  ban a terminated (former associate) employee  whom she feels is hostile and threatening , from shopping in her retail store and stepping foot on her premises.

    Yet continue to allow repeated shoplifters steal from her store time and time again, without banning those individuals  ?

    How is this making much sense ?

    And does this seem Fair ?

  • I got a ban from a discord server that was only supposed to last 2 weeks but its now been months. help?

    So I got banned from a discord server and the mods were supposed to unban me after 2 weeks but they never did. Ive been trying to reach back into the server recently but i found that im still somehow banned. Is there a way I could possibly contact the admins/moderators? or do something to fix this?

  • Is threatening someone at work for bullying a fellow colleague classed as gross misconduct or give cause for instant dismissal?

    There is a colleague at my workplace who has been bullied by the same two people for five months. It got to the stage, where this colleague left work in tears for what had been said and done. I had kicked off at the bully and told him to meet me after work at 10pm and gave him my address to pull up. My work knows I’m a quiet person and this is out of charecter. It is also the first time an incident like this has happened, I have since apologised and haven’t caused any physical violence to this person. The person being bullied has told the bully they’ll report the incident to our line manager, however the bully has blackmailed her and said if she does, then they will get me fired for threatening behaviour. However, with what the bully has said and done. And the fact it is my first offence. Is this grounds for dismissal?

  • Can you legally work a full time and a part time job?

    I’ve seen this question a lot but from past years (the answer was yes) but I was wondering if something had changed over the last years or if something it’s different where I live.

    So, I live somewhere in Texas and I have this part time job that I really love (involves pups) but I don’t usually get a lot of hours...& recently I got a part time at Fiesta (I was offered full too) & the scheduling thing it’s going to be a little difficult, so I was thinking about working part time, 1-3 days with the dogs & the rest of the week full time at fiesta. Is it legal? Are there any complications? Thanks.

  • Was this reasonable cause for termination , or are these claims frivolous ?

    I was let go and furthermore banned from company premises. 

    Due to claims of me speaking to management in a demeaning  disrespectful tone. It was added that I violated the company 's workplace violence policy by throwing a sheet of paper ( corrective action write up document) on the floor . The act of throwing the sheet of paper is being constituted as " Threat and violence with a weapon under statute in the handbook" from the words of the supervisor that terminated me via phone.

    Is there a way for me to dispute these claims with the workforce commission and or the state unemployment office?

  • any ways to transfer my salary to my boss?

     I'm an H1b holder, the company I work for has a hard time because of Covid.

    Yesterday, my boss told me he wouldn't hire me, but he's quite nice, he gives me 2 months to find another job.

    During this time, he still pays me a salary to make sure my H1b status works, but I'll pay him back in another way.

    It means he allows me to be employed, but I don't earn a salary.

    I'd like to know legal ways I can pay him back.
