    I need advice on unemployment appeal! HR lied about a no call no show...?

    My employer has a zero excuse 12 point attendance policy. I have a chronic health condition that I found out from my doctor should have been covered by FMLA the whole past year that I've been having issues, she brought up FMLA when I told her I was about to point out due to the condition. I didn't get covered until I was at 11 points.

    February comes and the artic vortex hit our area. On the morning of February 18 I went out to start my car for work and my battery was dead, I'm sure due to the subzero temperature. I immediately called work and let them know that I was going to be late and the reason, I figured I would be able to get a ride or a jump pretty quick. I was wrong, by 6:54 I knew I wasn't going to be able to get there by 7:30 (it's a 30 minute drive on good days and the roads were still pretty bad) so I called and left another voicemail as well as text my HR manager letting her know what happened and I understood that was my final point. She texted me back and said that she was 'sorry things didn't work out' and she 'wished me the best'. I filed for unemployment and received a letter from the state saying I was denied for 602-misconduct. My employer said that I was a no call no show on February 19, the day AFTER I pointed out! I sent in my appeal already, any advice going forward would be great! 

    And I was with the company for 10 years and made $65,000 yr.

    UK based question....Can my manager be fired for bullying?

    I am about to put in paperwork to ACAS for bullying and harassment at work which will lead to early conciliation, failing that I will then take the company to tribunal. I have a strong case where paperwork, evidence of my grievances and complaints not being dealt with and witness statements are concerned. I have also been advised I will definitely win my case whether the company settles at early conciliation or it is taken to tribunal.

    I was wondering, what happens to the managers that cause employees to take their companies to early conciliation or tribunal? The bullying and harassment was being done by a manager? Is there any reprimanding that is done or do the company just pay up and leave it there?

    It wasn't too many decades ago when it would have been shocking for a woman to wear pants/jeans/suit instead of skirt/dress and now no one bats an eye.   As far as I'm concerned, men deserve the same freedom/courtesy.

    Lack of Work unemployment?

    I work for a greenhouse and my boss continuously gives me days at a time off after guaranteeing me 40 hours, it started with a few days here and there but then it was a full week because there wasn't any work. Last night she texted me and said she is laying everyone off due to lack of work for at least another week or two and told me to file for unemployment. Here's the issue I see with that, it's seasonal work, we only work there 4 months out of the year and so far it has only been two, from my knowledge you have to work 18 weeks in the same company to file for unemployment. Would I be eligible to receive benefits while I'm out of work because of this or what can I do? Obviously I am looking for other work opprotunities in the mean time but this was sudden and unexpected and at no fault to my own. is there any options for me?

    Is this an unethical business practice ?

    Why would a store manager  ban a terminated (former associate) employee  whom she feels is hostile and threatening , from shopping in her retail store and stepping foot on her premises.

    Yet continue to allow repeated shoplifters steal from her store time and time again, without banning those individuals  ?

    How is this making much sense ?

    And does this seem Fair ?

    Is threatening someone at work for bullying a fellow colleague classed as gross misconduct or give cause for instant dismissal?

    There is a colleague at my workplace who has been bullied by the same two people for five months. It got to the stage, where this colleague left work in tears for what had been said and done. I had kicked off at the bully and told him to meet me after work at 10pm and gave him my address to pull up. My work knows I’m a quiet person and this is out of charecter. It is also the first time an incident like this has happened, I have since apologised and haven’t caused any physical violence to this person. The person being bullied has told the bully they’ll report the incident to our line manager, however the bully has blackmailed her and said if she does, then they will get me fired for threatening behaviour. However, with what the bully has said and done. And the fact it is my first offence. Is this grounds for dismissal?

    Was this reasonable cause for termination , or are these claims frivolous ?

    I was let go and furthermore banned from company premises. 

    Due to claims of me speaking to management in a demeaning  disrespectful tone. It was added that I violated the company 's workplace violence policy by throwing a sheet of paper ( corrective action write up document) on the floor . The act of throwing the sheet of paper is being constituted as " Threat and violence with a weapon under statute in the handbook" from the words of the supervisor that terminated me via phone.

    Is there a way for me to dispute these claims with the workforce commission and or the state unemployment office?

    this company hired me and exposed my personal information to coworkers in training?

    I work form home got hired  fro this company and was getting trained when the instructor told me to shae my screen , I of course benign new was not aware of all the info n the page. , I shared the screen , there are over twenty people in the training. It stayed on the page with my last for  ss my birthdate and age and PIN we use to sign paper work.  I was mortified when I saw what was being share  for over ten minutes! I am embarrassed, and feel exposed. I am going to contact the HR and  not sure how to approach this, I do not even wan to do the training but need the job. I thinking about suing. He just said "oh sorry" I JUST SAW THAT INFORMATION . I told him I felt mortified and exposed...that was it. any suggestions

    Sacked for being on my period and putting head on desk at call centre and answering calls everytime it rings...?

    I said it was my second day of my period and I didn't want to call in sick to avoid work while on probation but they said it doesn't look profession and they won't give me another chance. What do I do?

    I didn't do it throughout the day, I did it only like 30 minutes altogether within 8 hrs. But people still reported me.

    There is no specific yes or no answer to your question, as this issue is governed by state (rather than federal) labor law.  Some states require employers to pay for such mandatory items, other states do not, while still others take a mixed approach.  Additionally, if the employee is only making minimum wage other issues may arise.  You need to contact your state labor board to find out the rules for your locality.

    Can My Boss Write Me Up For Missing Work For Mandatory Training?

    So I work as a DSP (direct support profession) which works with taking care of handicap people for a living in a facility in California. My job has me doing mandatory training(online dsp classes) that are needed to keep my job and they have to be completed within a year of hire. I let my boss know that I wasn’t able to come in on 4 certain days because of this training, which mind you is 8hours long. She said I’ll be written up for missing each day of work but isn’t it technically working because I’m doing mandatory training??? This is training I HAVE to do. It’s not an option, I need it for the job. How am I getting written up if I’m technically working?? She’s also making me do an 8hour shift (so that I basically don’t get fired for so many write ups for missing “actual” work for training). I have to work 9pm to 5am and then do my classes the next day which are 8am to 4pm. Is this right?? Can she write me up for missing days AND make me work???

    Does My Job Have To Pay Me For Mandatory Training?

    I work as a direct support professional, working with mentally handicap patients in the state of California. My job requires me to have a certification/training outside of work on my own time in order to work there. The training is 8 hours long and mandatory to have this training within 6 months of hire or you can be terminated. Should I be paid for mandatory training outside of work or is it not against the law to not pay your workers for outside training? Also, if I do get paid for the training, is it considered overtime pay if I'm working an 8 hour shift and doing 8 hours or training within the same day?

    Is it mandatory to quarantine after traveling out of the state?

    I live in Texas, in the DFW area, where I work, they had said if any employee travels out of the country, they must be in quarantine for 15 days, but the part they didn’t mention is that you must have PTO to quarantine after your travel, a coworker of mine had to travel out of the country for a family funeral, when he return, he quarantine for 15 days, the 15 day passed, communicated with the supervisor that he will be returning to work, supervisor told him that he cannot return to work unless he brings a doctors note, so frustrating, telling him last minute of this news, called the HR, the HR told him that he wasn’t supposed to quarantine if he didn’t have PTO, was supposed to return to work immediately, people with PTO can quarantine...

    I’m here seeking any advice or help, should he just get a doctors note or take some different action? any advice would be great

    Company reduced my pay without telling me?

    I was making $2000 per 2 weeks paycheck ($4000 a month) for the entire year of 2020. Then my last 2 paychecks from December, they were only paying me $1800 per 2 weeks ($3600 a month). I have no clue why. I worked the same exact hours (40 hours a week like I always do), yet my paycheck was $200 less per 2 weeks. Is this legal? I signed a contract agreeing to a certain salary, is this breach of contract?

    Can my job look inside my nose? and if I refuse can they fire me?

    I got a piercing done in my septum, my boss saw it as I was sitting in my car after work (not even clocked in) and told me I needed to take it out completely when I work or I would be fired. I told him that is not happening as I just paid for it and its literally screwed in and extremely painful to move. Long story short he said take it out, quit, or you get fired. I told him I got it professionally removed because it was so painful to do my self. (I didn't) I got a piercer to insert a clear one that you could not see whatsoever except for in the hole. He literally and I quote said, "Unfortunately I will have to make sure your piercing is out before I let you come back" Is he going to look inside my nose? because like wtaf! is there any legalities I can use or something I can say? If he looks in my nose there's a 50% chance he's going to see the clear end.
