Girlfiend bought me a TV. Now we are breaking up. Who owns it?

When the TV was bought (55in Samsung), we lived together(still do but seperating now). Now we are breaking up and trying to divy things up. She bought me a TV to stop smoking in the house. I also gave her my old TV (40in Samsung) in return. She told me then that it was mine and was a gift, now she denies that. I tried paying her back for it and she wouldnt take the money. Now she wants the TV.

So my question is this.... She paid for it, but was a gift. It was bought in my name but with her debit card. It is registered to me through Samsung. Who owns it and the other (maybe) obvious question is, how do I prove it was a gift?

    This is not a marriage and divorce question. How petty can you two get? She doesn't want the tv. She wants to punish you. You own the tv, but there is no way to prove it in her mind. As it is registered to you, you don't need to prove it was a gift. And who are you proving this to? Just take your old tv back, give her the new one, and wish her well. You could point out that this type of behavior is why you don't want her around any longer, but women like her never see that.

    As far as I have seen on Court TV shows, gift is just that and belongs to the person to whom it was given. It wasn't a loan or joint purchase. You made an agreement which should be binding. That's the legal version. However there is also a moral issue here. Who is doing the breaking up? Do you want to remain friends? Do you feel guilty keeping it? Is it really worth all the ill feelings toward one another? I guess it depends on what is important to you. Since it is registered in your name, it would be yours.

    Whatever-- just give her the TV and use the money you would have given her to buy yourself a TV.

    Doesn't matter who's right or wrong-- it matters to be able to move on without creating or participating in a lot of drama.

    If the tv was given to you as a gift - its yours.

    technically it is yours but you might just want to cut your losses and hand it over to her.
