Where I can complain about my employer's cheating?

I am currently working for a small proprietorship company in India for last 3 months.I will be in probation period for 6 months.My salary was fixed and I'll be getting some performance bonus at the end of 3months.

Last 2 months they paid my salary only for working days,like they didn't pay for my Sundays.Office timings are 9 1/2 hrs everyday and I'm not getting any overtime benefits also.I'm not under any contract basis,I have been appointed as their regular employee.

Is this legally correct and where should I complain about their illegal practices.

    first go thru your contract terms and if you find lacuna in same, then you can file a legal complaint in your local Labour office of your area. you have full right to ask for over time, if you are doing that. it is paid on hourly basis i.e if you work for 4 extra hours you will be paid full day salary. or they can also give a compansatery off aginst your extra time. employer can only ask you to work for 48 hrs in a week.

    Hi,

    You should contact to HR department and discussed this issue with HR manager . There is a possibility that not paying on Sundays might be the company's policy.Paying overtime not be the policy of the company as well.

    If company pays overtime and you didn't get yet, then there is a possibility that the company is failed to track your time. Company must know the hours you spent each day so all your hours will be calculated each month, if you spend more hours than company actually required from you then you should be paid overtime.

    I think you should talk to Hr manager , if there is no Hr manager then talk to Manager. The employee is just like a customer for HR department. For instance: A company selling a product doesn't want to lose its customer because the customer is asset for the company. Similarly you are the customer of HR Department and asset for the company. Company doesn't want to loose you and happy to solve you problems.
