  • Divorce petition by wife and kidnap plans by husband?

    Wife filed divorce petition and also Domestic violence and kidnap plans by her husband & his brothers and also husband's friends. Cases have been booked against the husband his brothers and friends for the kidnap plans. The statements of two drivers and and one more person who was the friend of her husband recorded by the police.

    Recently one of the friends of the husband filed a false case against her father saying that he has threatened his friend pointing with his licensed revolver in the presence of the security provided to him by the government. It is a false case and this is being investigated by the high officials of the police department. In fact security get down from the car before the VIP gets down and enter into the car only after the VIP gets into the car. The government police security follow the guidelines framed by the government who are thoroughly disciplined.

    What is the way to deter these people not to file false cases in future against the family members and friends which is only to harass the VIP family. Her father is my friend.

    Mr. Vijay sir may help in this regard. Other experts views are also welcomed.

  • FIR/Charge sheet related issue?

    I would wish to know on the following issues:

    1. Entry in GD in PS - How long the complaint can be in general diary (GD) from the date of complaint.

    2. After FIR is registered within how many days charge sheet to be filed.

    3. Is there any scope for delay in filing charge sheet after the FIR is registered, if so under what circumstances.

    Any other info. on this issue is appreciated.

  • What protection can be asked for senior citizen if someone or group of people create nuisance.?

    Under the new laws for senior citizen, what protection the police can give if some people gather regularly at a place which disturbs the senior citizens particularly who are suffering from certain illness despite requesting such people not to disturb but continue to disturb the peace of the senior citizen. Who is appropriate authority for complaining.

    These days even the school going children drive the vehicles and disturb with horn meaninglessly and gathering at the residential locations and loudly talking which creates restlessness to the senior citizen.

    Your views will be helpful to the senior citizen.

    I got married in the year 1976. My wife's name is changed after the marriage. All her educational certificates are in maiden name. We want apply for passports for my self and my wife. Since all the accounts are in her maiden name like bank accounts, ration card, aadhar card, bank lockers and voter id card and even in respect of few shares held by us jointly. Since she do not have any educational certificates in her married name except her maiden name. Since all the records are in her married name, we have to apply for pass port in her married name and in that case we have to show in educational column as illiterate. In the marriage affidavit can we show her maiden name followed by married name and if this is followed then can we show her educational qualifications of her maiden name. Any other useful guidance is welcome.

    Divorce by a woman from her husband.?

    This girl and the boy were in love from the school days. When the girl reached 20 years she married the boy without the knowledge of her parents. He is not of a good character as his father himself given in writing saying that the father takes the responsibility of mending his son. Of late say for the last few years he is habituated with drinks heavily and started torturing the girl. I May 2013 he beat the girl and snatched the Mangalsutra and after this incident her brother brought her back to their parents home and she is staying with the parents eversince. Her brother gave his flat for stay in the house without any rent being his sister. Even after she was brought to the parents' house the boy was staying in the house with his friends and spoiling the atmosphere of the apartment. Having come to know of the illegal activities, the brother of the girl brought the keys locking the door as the house belongs to the girls him due to illegal activities in otherwise the decent apartment and people living in the said apartment. The girl is the daughter of a VIP and this man misusing his name for his benefit like earning money or borrowing money.

    She recently complained in the Police Station as she was receiving the threat calls from the boy. He is interested in living with her despite severe harrasment and torture because of the girls father's status in the society. They married in May 2001. Parents were not knowing till 2002.

    Whether she can seek the divorce from her husband if her husband unwilling to accept the divorce.

    Is pulling of Mangalsutra can be one of the grounds for divorce as sanctity of the mangalsutra disrespected. Because of his drinking habits they are not staying like wife and husband under the same roof for the last few years say 3 years. This is a Hyderabad case. The VIP is my friend.

  • Can holder of Power of Attorney get the property in his own name belongs to Principal?

    The Power of Attorney granted by the Principal to the Agent to do certain things which he himself can not do due to disability or staying overseas with the clauses the attorney can sell moveable or immoveable properties and all acts done by the attorney are as if done by the Principal. Can the attorney get the properties in his own name belongs to principal signing as the attorney for the properties of the principal. If this is allowed the purpose of granting power of attorney has no sanctity.

There is no need for him to adopt the another brother's daughter having adopted a male child. She claims, she is the adopted daughter for a claim in the property.
