Now PraNab da has become as President elect of India. Can he give "verdict" on hanging of Afzal Guru?

    Most of our Most Respected PRESIDENTS have not given their verdict on the Mercy Petitions for Years. When Dada was a very senior member of the Cabinet, the decision could not be taken. How can we expect to get a decision from the President when the Government is all set the delay the hanging as possible.

    Under the Constitution of India, the President has no independent power to act and is bound by the 'aid and advice' of the Council of Ministers, that is, the cabinet. The cabinet has its own rules of business and the functions of cabinet are assigned to individual ministries, with sub-delegation of powers, to deputy minister, minister of state and the cabinet minister. Some delegation is there for cabinet sub-committees and some others are for group of ministers, specially constituted. Full cabinet decides on very few important policy matters and approval of draft legislations.

    The President is thus to await the recommendation of the Home Ministry, which may place the matter before the Consultative Committee, consistimg of members of parliament. It may be placed before the National Security Council also.

    There is no time limit for the President to signify the decision. He may seek clarifications on any issue which may entail time lag. There is no limit to the number of times such clarifications can be sought.

    All the above would enable one to understand the intricacies involved. There can be no mechanical application of exercise of or refusal to exercise of the Executive clemency power which is a sovereign function of the State.

    A correction: The president is not vested with any power to give any 'verdict'. It is the power of the judiciary.

    Now reverting to your poser,Pranab probably doesn't even know who Afzal Guru is.Also no one is going to put up files for commutation anytime soon.First he will be given time to plan his foreign visits

    for sightseeing and enjoyment with his family and relatives.All the earlier visits were official and short.Now he can enjoy at leisure.He would already be looking out for a site for his new house that he will get on retirement.May be by the time his term ends,unless he is reelected,the Home Ministry may

    put up files for his disposal.Till then Afzal will continue to grow older.

    Indian President always makes decision on the advice of Home ministry/ Law MINISTRY and PMO and in Afzal case UPA Govt is not willing to hang him or change the status to life imprisonment due to political reasons and everyone is aware of it.

    That power lies with Sonia Gandhi. Pranab Mukherjee cannot veto what Sonia commands and demands.
