I was wondering that lets suppose Krishna comes forward and says that he did commit the murder, but then does the state or the country have a right to take away his life?

I mean isnt the state actually doing what he did but then hiding the murder under the pretext of justice

please post some reasonable answers as to how actually the state can punish Krishna and if a lawyer had to argue opposing to death peanalty in this case how the lawyer would go about?
